Rosa’s Law
Rosa is a 9 year-old girl whose case inspired the enactment of a law known as Rosa’s Law. This law seeks to ban the use of the derogatory, discriminatory term ‘mental retardation’ in the labor market, educational institutions, and the healthcare sector. It seeks to replace the term ‘mental retardation’ with a more dignified term, ‘intellectual disability’ (Special Olympics, n.d.). The second born among three children, Rosa suffers from Down syndrome, a condition where individuals have extra chromosomes that affect the body’s as well as brain’s development, leading to mental as well as physical challenges (Centers for Disease Control and Prevention, 2021). She obtains a lot of support from her family, notably her mother who prohibits everyone in her family from using the word ‘retardation’ when describing Rosa. More importantly, Nina’s mother joined hands with other parents together with the Maryland state delegate in introducing a motion seeking to remove the term ‘mental retardation’ (Special Olympics, n.d).
Rosa’s law means that people with intellectual disabilities deserve respect; they ought to be handled with utmost dignity. It recognizes that words that are often used when referring to people like Rosa, who has Down syndrome, are very hurtful. Equally importantly, the law means that the government understands that persons with intellectual disability are not lesser beings and deserve full protection under the law. It was signed into federal law by the former U.S. President Barack Obama on October 5th, 2010 (Special Olympics, n.d.).
What I like most about Rosa’s law is that it seeks to create awareness and sensitivity among people. Reading about this law, it strikes me that too often people use derogatory terminologies, albeit unconsciously when referring to their peers or colleagues that are abled differently. In my view, Rosa’s law is a good point of reference in the society in efforts to embrace the idea of being abled differently. I also find it interesting that the testimony of Rosa’s 11-year-old brother produced the greatest influence during the hearing. Without doubt, the boy’s remarks are so moving and provide an excellent summary of how hurtful the ‘mental retardation’ terminology is.
